ORDER

¶ 1 Department II of the Court, composed of Chief Justice Madsen and Justices Owens, J.M. Johnson, Wiggins and Gordon McCloud, considered this matter at its February 5, 2013, Motion Calendar and unanimously agreed that the following order be entered.

¶ 2 IT IS ORDERED:

¶ 3 That the Petitioner's Motion for Discretionary Review is granted. The State's Motion to Allow the Trial Court to Resentence Petitioner is granted and this matter is remanded to the trial court to resentence the Petitioner. The Petitioner's Motion for Appointment of Counsel is denied.
