ORDER MODIFYING OPINION AND DENYING REHEARING
THE COURT:
It is ordered that the opinion filed herein on June 16, 2003, be modified in the following particulars:
1. On page 2, in the first sentence of the initial paragraph under the heading Statement of Facts and Procedural History, the phrase "due to chronic drug abuse by the parents" is deleted. The phrase "based upon sustained allegations of chronic drug abuse" is inserted so that the sentence reads:
Appellants Anthony and Shauna are the parents of the two minors Ryan and Anthony Jr., who were born in 1994 and 1997, respectively, and were declared dependents of the juvenile court in July of 1998, based upon sustained allegations of chronic drug abuse, domestic violence in the home, an incident of physical abuse, and neglect.
There is no change in the judgment.
The petition for rehearing is denied. --------------- Notes: Anthony is not the biological father of Ryan. Ryans biological father, David, did not participate in the dependency proceeding and is not a party to this appeal. During the course of this proceeding, Anthony was declared the presumed father of Ryan. For purposes of the issues presented in this appeal except compliance with the Indian Child Welfare Act, we treat Anthony as the father of both Ryan and Anthony Jr.
