This appeal from the trial court's August 18, 2023 final order in suit to modify parent-child relationship was filed August 31, 2023 as a petition for permissive appeal, see Tex. R. App. P. 28.3, but we subsequently construed the petition as a notice of appeal under Texas Rule of Appellate Procedure 25.1, see id. 25.1. A review of our case management system, however, reflects an appeal from the same final order was separately filed and docketed as appellate cause number 05-23-00858-CV. Accordingly, because this appeal is a duplicate of cause number 05-23-00858-CV, we CONSOLIDATE the appeal into appellate cause number 05-23-00858-CV. All documents from this appeal shall be transferred into appellate cause number 05-23-00858-CV. The parties shall proceed now under cause number 05-23-00858-CV alone.
For administrative purposes, this appeal is treated as CLOSED.
We DIRECT the Clerk of the Court to send a copy of this order to Dallas County District Clerk Felicia Pitre; Donna Kindle, Official Court Reporter for the 303rd Judicial District Court; and the parties.
