DECISION & ORDER ON MOTION FOR REINSTATEMENT

Motion by Marc Evan Rovner for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Rovner was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on December 14, 1988. By opinion and order of this Court dated January 23, 2007, Mr. Rovner was disbarred, effective immediately, based on his conviction of a felony, and his name was stricken from the roll of attorneys and counselors-at-law.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that on the Court's own motion, the opinion and order dated January 23, 2007, is amended by deleting from the second decretal paragraph thereof the words "effective immediately" and substituting therefor the words "effective August 15, 2005"; and it is further,

ORDERED that the motion is held in abeyance and the matter is referred to the Committee on Character and Fitness to investigate and report on Marc Evan Rovner's current fitness to practice law.
