ORDER MODIFYING OPINION AND DENYING REHEARING

FRANSON, J.

It is ordered that the published opinion filed in the above entitled action on July 21, 2011, is modified as follows:

In the first full paragraph on page seven, the sentence “The juvenile court noted he had a girlfriend, and the probation officer’s report indicates appellant intended his comments to be taken as a joke” is deleted.

This modification does not affect the judgment. Respondent’s petition for rehearing is denied.
