This proceeding arises out of Cause No. CC-16-60, styled In the Matter of the Marriage of Veronica Rodriguez and Pedro Rodriguez and In the Interest of Pedro Rodriguez III, pending in the County Court at Law, Starr County, Texas, the Honorable Orlando Rodriguez presiding.

ORDER

PER CURIAM

On October 26, 2023, the trial court signed an "Order for the Production of Documents," ordering relator Pedro Rodriguez to produce copies of financial documents by November 10, 2023 to real party in interest Veronica Rodriguez's attorney Flor E. Flores. The order also recessed trial until December 1, 2023 at 9:00 a.m. On November 22, 2023, relator filed an "Expedited Motion for Continuance," requesting a continuance of the December 1, 2023 trial setting and production of documents to allow for the complete retrieval of documents. On November 28, 2023, the trial court denied relator's motion.

On November 30, 2023, relator filed a petition for writ of mandamus complaining of the trial court's denial. He also filed an emergency motion asking this court to stay the proceeding to maintain the status quo of the parties and preserve this court's jurisdiction to consider the merits of his petition.

After consideration, we grant relator's emergency motion as follows:

The following paragraphs in the trial court's October 26, 2023 order are stayed pending further order of this court:

Respondent PEDRO RODRIGUEZ is ORDERED to produce the above documents to Petitioner VERONICA RODRIGUEZ's attorney, Flor E. Flores, The Law Firm of Flor E. Flores, PLLC at 102. N. East St., Rio Grande City, Texas 78582 by November 10, 2023 before the end of the business day.
IT IS FURTHER ORDERED that Respondent PEDRO RODRIGUEZ's failure to produce the documents listed above within the deadline imposed by this Order will result in the finding of contempt of Court which could result in incarceration for a period of time determined by the Court.

Additionally, the trial court's December 1, 2023 trial setting is stayed pending further order of this court.

It is so ORDERED.
