Opinion

No. 29 2013.

2013-01-25

In the Matter of a Member of the Bar of the Supreme Court of the State of Delaware Elizabeth RODRIGUEZ, Respondent.

ODC File Nos.2012–0354–B, 2012–0353–B, 2012–0098–B, 2012–0182–B.
Before HOLLAND, BERGER and RIDGELY, Justices.

ORDER

RANDY J. HOLLAND, Justice.

This 25th day of January, 2013, upon the Joint Petition of the Office of Disciplinary Counsel (“ODC”) and Elizabeth Rodriguez, Esquire, pursuant to Rule 19(c) of the Delaware Lawyers' Rules of Disciplinary Procedure (“Procedural Rules”), to transfer Ms. Rodriguez to disability inactive status, it appears Ms. Rodriguez is suffering from emotional and/or mental health problems which adversely affect her ability to practice law. It also appears that Ms. Rodriguez' responsibility for client matters will be assumed by Edward Curley, Esquire, who will transfer active matters to successor counsel and conclude the billing and distribution of any client funds or funds held in escrow. The Court has reviewed the Joint Petition and has concluded it is in the best interest of the public to place Ms. Rodriguez on disability inactive status for an indefinite period of time.

NOW, THEREFORE, IT IS HEREBY ORDERED THAT:

Elizabeth Rodriguez is hereby transferred to disability inactive status until such time as she can demonstrate by clear and convincing evidence that any disabilities have been removed. This Order shall be made public.
