ORDER MODIFYING OPINION AND DENYING REHEARING [NO CHANGE IN JUDGMENT]

THE COURT:

It is ordered that the opinion filed herein on March 11, 2011, be modified as follows:

1. On page 2, the last sentence of the first full paragraph is modified to read as follows:

On January 15, 2009, defendant admitted the allegation, but withdrew his admission in March, after a probation report found him unsuitable for deferred entry of judgment.

2. On page 2, the fifth sentence of the second full paragraph should be modified to read as follows:

On May 12, 2009, the juvenile court dismissed two counts of the supplemental petition.

3. On page 3, the second full paragraph should be modified to read as follows:

While the case was venued in Fresno, the juvenile court had ordered a psychological evaluation of defendant. The evaluation, prepared by Nilakshi Wanaguru and dated March 2, 2009, reported defendant denied molesting his stepsister, and displayed no remorse, guilt, or empathy. Wanaguru concluded he might not be amenable to treatment “due to his overly virtuous manner of denial and his over-controlled hostility.” Wanaguru also believed there was a significant risk defendant would reoffend and recommended he participate in individualized sex offender therapy.

4. On page 6, the fourth sentence of the first full paragraph should be modified to read as follows:

However, these programs met only about once a week.

There is no change in the judgment.

Appellant’s petition for rehearing is denied.
