ORDER
We REINSTATE this appeal which we abated to allow the trial court to conduct a hearing to determine if the October 5, 2015 reporter's record accurately reflected and contained the exhibits admitted at trial. The reporter's record from that hearing, which was held January 27, 2016, has been filed, but the clerk's record containing the trial court's findings of fact from that hearing has not.
By letter dated February 10, 2016, Collin County District Clerk has informed us that no findings of fact have been filed or signed. Accordingly, we ORDER the Honorable John Roach, Jr., Presiding Judge of the 296th Judicial District Court, to make, sign, and file the requested written findings no later than March 1, 2016. We further ORDER Collin County District Clerk Yoon Kim to file, no later than March 4, 2016, a supplemental clerk's record containing those findings.
We DIRECT the Clerk of the Court to send a copy of this order to Judge Roach, Mr. Kim, and the parties.
We ABATE the appeal to allow the trial court an opportunity to enter the findings. The appeal shall be reinstated by March 11, 2016 or when the clerk's record is filed, whichever occurs sooner.
