ORDER
We REINSTATE this appeal.
We abated this accelerated appeal to allow the trial court an opportunity to conduct a hearing to determine if appellant, who is indigent, wished to be represented by counsel as the clerk's record reflected appellant's counsel, Timothy Haney, had been allowed to withdraw. At our direction, the trial court filed written findings of fact. Among the court's findings are that appellant desires to prosecute the appeal and has been appointed counsel.
The court's findings are included in a supplemental clerk's record. Also included in the supplemental record is the trial court's order appointing Rick Dunn as counsel for appellant. We ADOPT the trial court's findings and DIRECT the Clerk of the Court to substitute Rick Dunn for Timothy Haney as counsel for appellant.
We note appellant's brief is due to be filed by February 19, 2018. However, court reporter Cindy Bardwell has informed the Court the record of four additional hearings have recently been requested. She asks she be allowed to file the record by February 15, 2018. We GRANT the request and ORDER the supplemental reporter's record of the requested hearings be filed no later than February 15th. Because this is an accelerated appeal, extension requests will be disfavored.
Appellant's brief shall now be filed within ten days of the filing of the supplemental reporter's record.
