In re Rivera v. Safir

Appellate Division of the Supreme Court of New York, First Department
Feb 23, 2000
269 A.D.2d 257 (N.Y. App. Div. 2000)

Opinion

February 23, 2000

Order, Supreme Court, New York County (Bruce Allen, J.), entered June 23, 1999, which denied petitioner's application pursuant toCPLR article 78 to annul his termination as a probationary police officer with the New York City Police Department, unanimously affirmed, without costs.

Peter D. Coddington, for Petitioner-Appellant.

John Hogrogian, for Respondents-Respondents.

TOM, J.P., RUBIN, ANDRIAS, BUCKLEY, FRIEDMAN, JJ.

Petitioner's contention that, pursuant to Unconsolidated Laws § 891, he was entitled to a pretermination hearing notwithstanding his probationary status has recently been rejected by this Court (see, Matter of Williams v. Safir, 265 A.D.2d 182; 696 N.Y.S.2d 139, lv denied 94 N.Y.2d 758, 2000 N.Y. LEXIS 5), and the present matter affords no reason to reach a different result.

THIS CONSTITUTES THE DECISION AND ORDER OF SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
