This proceeding arises out of Cause No. 14716CR, styled The State of Texas v. Jose del Carmen Lopez Rivera, pending in the County Court, Kinney County, Texas, the Honorable Natalie C. Fleming presiding.

ORDER

PER CURIAM

On February 22, 2024, Relator Jose del Carmen Lopez Rivera filed a petition for writ of mandamus. Lopez Rivera also filed an emergency motion to stay the underlying proceedings pending our final resolution of the petition for writ of mandamus. This court believes a serious question concerning the mandamus relief sought requires further consideration. See TEX. R. APP. P. 52.8(B). THE RESPONDENT AND THE REAL PARTY IN INTEREST MAY FILE A RESPONSE TO THE PETITION IN THIS COURT on or before March 21, 2024. Any such response must conform to Texas Rule of Appellate Procedure 52.4.

Lopez Rivera's request for an emergency stay is GRANTED. The underlying proceeding is STAYED pending further order from this court.

It is so ORDERED.
