THE COURT:

It is ordered that the opinion filed herein on May 16, 2008, be modified as follows:

On page 2, the last sentence of the second paragraph stating, “Thus he has no appeal pending in this court” is deleted and replaced with the following sentence:

Thus, he is precluded from raising any claims based on the denial of the mother’s request for modification.

There is no change in judgment.
