PRETRIAL ORDER NO. 77 (Disposition of Motion for Voluntary Dismissal)


Plaintiff moves to dismiss this action without prejudice on the heels of its transfer here by the Judicial Panel on Multidistrict Litigation following its removal from the Circuit Court of LeFlore County Mississippi.

The motion assigns no grounds for the relief sought and cites no pertinent authority for any proposition save that dismissal without prejudice may be appropriate where an action has not been pending long. It is denied.

Although the Court does not rely on the additional facts, it notes also that the papers are not in the form required by orders previously entered in this Court and that the attorney who signed the papers appears neither to be a member of the Bar of this Court nor to have obtained leave to appear pro hac vice.

SO ORDERED.
