IN RE ERIC REYNA

ON PETITION FOR WRIT OF MANDAMUS

Before Chief Justice Contreras and Justices Longoria and Pena

ORDER

PER CURIAM

Relator Eric Reyna filed a petition for writ of mandamus asserting that the trial court abused its discretion by denying discovery in the underlying personal injury case. Relator has also filed an emergency motion for stay on grounds that the case is set for trial in August, discovery is ongoing, and trial deadlines are approaching as early as next month. Relator contends that the discovery at issue is "absolutely critical to a fair adjudication" of relator's claims.

The Court, having examined and fully considered the emergency motion for stay, is of the opinion that it should be granted. Accordingly, we grant the emergency motion for stay, and we order the trial court proceedings to be stayed. See TEX. R. APP. P. 52.10. The Court requests the real party in interest, McCoy Corporation d/b/a McCoy's Building Supply, or any others whose interest may be affected by the relief sought, to file a response to the petition for writ of mandamus on or before the expiration of ten days from the date of this order. See id. R. 52.2, 52.4, 52.8.
