(T. NO. 16-1-0117) ORDER DISMISSING APPEAL PURSUANT TO HRAP RULE 30

Upon review of the record, it appears that: (1) the deadline to file the Opening Brief by Beneficiary-Appellant Steven Christian Du Pont (Appellant) was September 18, 2017; (2) on September 14, 2017, the deadline for Appellant to file his Opening Brief was extended by the appellate clerk to October 18, 2017; (3) on September 14, 2017, this court temporarily remanded the case to the Circuit Court to determine a motion by counsel for Appellant to withdraw, and the deadline to file Appellant's Opening Brief was extended to November 23, 2017; (4) on October 26, 2017, the Circuit Court granted a motion to withdraw by Appellant's counsel and ordered pro hac vice counsel to associate with local counsel by October 18, 2017, or his pro hac vice admission to represent Appellant would be terminated; (5) no appearance of substitute local counsel for Appellant appears in the record on appeal or the appellate record; (6) on January 2, 2018, Appellant was notified that the time to file his Opening Brief expired on November 23, 2017, the appeal could be dismissed, and that the matter would be called to the attention of this court on January 12, 2018; (7) as of January 23, 2018, no Opening Brief or motion for relief from default was filed by Appellant.
Therefore, IT IS HEREBY ORDERED that the appeal by Beneficiary-Appellant Steven Christian Du Pont is dismissed, pursuant to Hawai'i Rules of Appellate Procedure Rule 30.
