Original Mandamus Proceeding

This proceeding arises out of Cause No. 2005-CI-16736, styled Reliant Surgical, L.P., v. Alphatec Spine, Inc., formerly known as Alphatec Manufacturing, Inc., and Patrick Kocurek, pending in the 288th Judicial District Court, Bexar County, Texas, the Honorable Lori D. Massey presiding. However, the challenged order was signed by the Honorable John J. Specia, Jr., presiding judge of the 225th Judicial District Court, Bexar County, Texas.

Petition for Writ of Mandamus Denied.

MEMORANDUM OPINION


On February 3, 2006, relator filed a petition for a writ of mandamus. The court has considered relator's petition and is of the opinion that relator is not entitled to the relief sought. Accordingly, relator's petition for a writ of mandamus is denied. See Tex.R.App.P. 52.8(a).
