AGREED ORDER MODIFYING PRETRIAL SCHEDULING ORDER ON REGAL CINEMAS, INC.'S OBJECTION TO THE CLAIM OF 95-85 ASSOCIATES


Upon the Joint Motion to Modify Pretrial Scheduling Order on Regal Cinemas, Inc.'s Objection to the Claim of 95-85 Associates (the "Joint Motion") filed by Regal Cinemas, Inc. ("Regal") 95-85 Associates ("Benderson 95-85"), and George Bellows, Receiver ("Receiver") (collectively, the "Movants"); and the Movants having agreed, as evidenced by the signatures of counsel below, to modify the Pretrial Scheduling Orders previously entered by the Court; and the Court being otherwise sufficiently advised;

IT IS HEREBY ORDERED that any dispositive motions (the "Motions") shall be filed on or before February 12, 2003, it being recognized that Regal filed such a dispositive motion on January 30, 2003; and

IT IS FURTHER ORDERED that responses (the "Responses") to the Motions shall be filed on or before February 20, 2003; and

IT IS FURTHER ORDERED that any replies (the "Replies") to the Responses shall be filed on or before February 28, 2003; and

IT IS FURTHER ORDERED that a hearing on the Motions will be held on March 5, 2003 at 9:00 a.m. in Courtroom 3, Customs House, 701 Broadway, Nashville, Tennessee; and

IT IS FURTHER ORDERED that the Required Disclosures in LBR 7026-1(b)(1)(i) and (ii) shall be served on or before February 5, 2003; and

IT IS FURTHER ORDERED that a trial will be held on a date to be determined by the Court in light of the Court's ruling on the Motions.
