This matter having come to be heard upon the claim filed by the New York State Department of Taxation and Finance ("NYSDTF"), Claim No. 1609 (the "Claim") and the Objection to the Claim filed by Regal Cinemas, Inc. ("Regal"); and the NYSDTF having filed an amended claim in the amount of $936,923.33, Claim No. 1939 (the "Amended Claim"); and the parties having agreed, as signified by the signatures of counsel below, that it is in the best interests of both parties, and will be more efficient, to continue the pretrial conference on the Claim and combine it with Regal's forthcoming objection to the Amended Claim; and the Court being otherwise sufficiently advised;
IT IS HEREBY ORDERED that the pretrial conference shall be continued and combined with the pretrial conference to be held on Regal's objection to the Amended Claim; and
IT IS FURTHER ORDERED that nothing in this Agreed Order shall affect the rights of either Regal or NYSDTF with respect to the allowance or disallowance of the Claim or the Amended Claim.
