MEMORANDUM OPINION


Before the Court are Relator's Petition for Writ of Habeas Corpus, real party in interest's Motion to Dismiss for Lack of Jurisdiction, and Relator's Motion to Treat Habeas Corpus Petition as Mandamus Petition or, in the Alternative for Leave to File Amended Petition. The facts and issues are well known to the parties, so we need not recount them herein. Relator was not held in contempt for violation of a court order; therefore, this Court does not have jurisdiction over this petition. Tex. Gov't Code Ann. § 22.221(d) (Vernon 2004). Accordingly, we DISMISS relator's petition for writ of habeas corpus for want of jurisdiction. We further DENY Relator's Motion to Treat Habeas Corpus Petition as Mandamus Petition or, in the Alternative for Leave to File Amended Petition. Finally, we VACATE our May 29, 2009 order granting relator emergency relief.
