ORDER
Through counsel. Appellee Natalia Merion Burcar (Natalia) moves this Court for dismissal of appeal with prejudice. Self-represented Appellant Richard Dane Renn (Richard) has not filed a response.
Natalia explains that Richard has not been truthful with this Court. Natalia states that Richard filed his Notice of Appeal on April 21, 2022, and that this Court received the District Court record on June 2, 2022. Natalia states that Richard has not filed his opening brief. Natalia further states that while Richard filed his second motion for extension of time on October 5, 2022, Richard did not serve Natalia's counsel with a copy of the motion. Natalia only learned about the extension of time from the Court's October 6, 2022 Order granting the motion. Natalia further provides that Richard has not contacted the Court Reporter for payment of the transcripts and references the Court Reporter's October 24, 2022 Notice, filed with this Court. Natalia asserts that Richard has lied to this Court about paying for the transcripts and about the reasons for extensions of time. Natalia requests dismissal of the appeal with prejudice because Richard has not complied with the Montana Rules of Appellate Procedure and has provided false information.
Upon review, Natalia's motion is well-taken. Therefore, IT IS ORDERED that Natalia's Motion to Dismiss Appeal with Prejudice is GRANTED and this appeal is DISMISSED with prejudice.
