On Application for a writ of Mandamus Cause No. 114-2075-07-AAE in the 114th District Court from Smith County

ORDER

PER CURIAM.

Applicant was convicted of sexual assault of a child and sentenced to life imprisonment. Applicant filed this application for writ of mandamus directly to this Court regarding the processing of an 11.07 application that had been filed in Smith County.

On April 3, 2024, this Court dismissed the application because an abuse of writ order had already been entered in this cause number. However, that abuse order only affects the filing of habeas applications, not mandamus applications. Therefore the dismissal of this application was improper. After reconsideration on its own motion, the Court finds that the leave to file the mandamus application should have been denied. Accordingly, the Court withdraws its prior order dismissing this application and enters an order denying leave to file this application.

The motion for leave to file this application is denied.
