ON APPLICATION FOR A WRIT OF MANDAMUS CAUSE NO. 2021040089 IN THE 369TH DISTRICT COURT FROM CHEROKEE COUNTY

ORDER

Per curiam.

Relator has filed a motion for leave to file an application for a writ of mandamus under this Court's original jurisdiction. He contends that he filed an application for a writ of habeas corpus pursuant to Article 11.072 of the Texas Code of Criminal Procedure in Cherokee County on April 8, 2021, that the State filed an answer on April 22, 2021, but that the trial court has not timely entered an order granting or denying relief as required by Article 11.072, Sections 6 and 7.

Respondent, the Judge of the 369th District Court of Cherokee County, shall state whether he has entered an order granting or denying relief pursuant to Relator's Article 11.072 habeas application, and if not, why not. If Respondent does enter an order granting or denying relief, Respondent shall include a copy of that order with his response. Respondent shall respond within fifteen days from the date of this order. No extensions will be granted. This motion for leave to file will be held until Respondent has complied with this order.
