Pursuant to Fed.R.Bankr.P. 7041 and Fed.R.Civ.Pro. 41(a)(1), Plaintiff and Counterdefendant RailWorks Corporation ("RailWorks"), a reorganized debtor herein, and Defendants and Counterclaimants Henry D. Hoge, Doña P. Hoge, and the Henry D. Hoge and Doña P. Hoge Family Trust (collectively, the "Hoge Parties") and Defendant Ronald K. Losch ("Losch"), by their undersigned counsel, hereby stipulate to the dismissal with prejudice of the Motion for Contempt and Award of Compensatory Damages (Docket No. 7) filed herein by RailWorks against the Hoge Parties and Losch on August 14, 2007.
NOW, THEREFORE, it is, by the United States Bankruptcy Court for the District of Maryland, SO ORDERED. SO ORDERED.
