IN THE INTEREST OF R.A. Jr., A JUVENILE Appellant,
Appeal from the 65th District Court of El Paso County, Texas (TC# 2300050)
ORDER
PER CURIAM
On November 20, 2023, Robert R. Harris and Matthew Dekoatz, counsel for Appellant R.A. Jr., a juvenile, notified this Court of the trial court signing an order, on November 1, 2023, granting a motion of withdrawal of said counsel as attorneys of record for Appellant. Informally, Attorney DeKoatz informed this Court by email that neither he nor attorney Harris intend to file any motion with this Court nor otherwise continue with their representation of Appellant's appeal. Previous to this notice, however, a notice of appeal had been signed and filed with this Court on October 31, 2023, wherein it represented that attorneys Harris and Dekoatz were perfecting this appeal as Appellant's attorneys of record.
Because this Court does not have the authority to appoint new counsel, this appeal is abated. It is ORDERED that the trial court conduct a hearing to determine if Appellant R.A., Jr. has retained new counsel or whether he is entitled to court-appointed counsel. The trial court shall forward its order and/or findings to the District Clerk of El Paso County on or before December 21, 2023. The District Clerk shall prepare a supplemental clerk's record containing the trial court's order and/or findings on or before December 21, 2023. Further, the transcription of the hearing shall be prepared, certified, and filed with this Court on or before December 21, 2023.
IT IS SO ORDERED.
