ORDER MODIFYING OPINION AND DENYING REHEARING NO CHANGE IN THE JUDGMENT

Duffy, J.

THE COURT:

It is ordered that the opinion filed herein on October 28, 2008, be modified as follows:

On page 10 in the final sentence of the first full paragraph beginning with the words “But except for . . .” add the word “substantial” before the word “evidence” so the sentence reads as follows:

“But except for an arrearage of unknown extent in child support, there is no substantial evidence that R. C., Sr., has been a deficient parent toward R. C., Jr.”

There is no change in the judgment.

The petition for rehearing is denied.
