ORDER CONSOLIDATING CASES
This matter is before the court on defendant Qwest Communications International, Inc.'s unopposed motion to consolidate [# 8], filed in 02-RB-2120 on July 11, 2003. In her Complaint, plaintiff Mary Stuhr alleges various claims under the Employee Retirement Income Security Act (ERISA). The plaintiff claims that the defendants are fiduciaries of the Qwest Savings and Investment Plan, and that the defendants violated duties and requirements imposed by ERISA. This case has substantial questions of law and fact in common with the cases consolidated under Case No. 02-RB-464. Under FED. R. CIV. P. 42(a), the court may consolidate cases involving common questions of law or fact. THEREFORE IT IS ORDERED as follows:
1) That under FED. R. CIV. P. 42(a), and D.C.COLO.LCivR 42.1, Case No. 02-RB-2120 is CONSOLIDATED with Case No. 02-RB-464;
2) That the Order of Reference to Magistrate Judge O. Edward Schlatter in Case. No. 02-RB-2120 is WITHDRAWN;
3) That the Order of Reference to Magistrate Judge Craig B. Shaffer in Case No. 02-RB-464 shall continue to govern the consolidated cases;
4) That Case No. 02-RB-2120 shall be added to the listing of consolidated actions in the caption of Case No. 02-RB-464.
