Opinion

No. 05-11-01526-CV

Opinion Filed November 16, 2011.

Original Proceeding from the Justice of the Peace Court, Precinct Number 3, Place 1 Dallas County, Texas, Trial Court Cause No. JC 11-00336A.

Before Justices MOSELEY, RICHTER, and FILLMORE.

MEMORANDUM OPINION

Before the Court is relator's petition for writ of mandamus complaining that the justice of the peace court granted a bill of review overturning a default judgment. The facts and issues are well known to the parties, so we need not recount them herein. This Court does not have mandamus jurisdiction over the justice of the peace. See Tex. Gov't Code Ann. § 22.221 (Vernon 2004); In re Spencer, No. 05-11-00636-CV, 2011 WL 2150782, at *1 (Tex. App.-Dallas June 2, 2011, orig. proceeding) (mem. op.); Casner v. Rosas, 943 S.W.2d 937, 938 (Tex. App.-El Paso 1997, orig. proceeding); Easton v. Franks, 842 S.W.2d 772, 773 (Tex. App.-Houston [1st Dist.] 1992, orig. proceeding). Accordingly, we DISMISS relator's petition for a writ of mandamus for want of jurisdiction.
