Opinion

No. 05-07-00084-CV.

February 5, 2007.

Original Proceeding from the County Court at Law No. 5 Dallas County, Texas Trial Court Cause No. CC-06-10622-E.

Writ of Mandamus Denied

Before Justices WRIGHT, O'NEILL, and LANG.

MEMORANDUM OPINION

Relator contends the trial judge erred in denying relator's motion to compel arbitration and stay the judicial proceedings. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relator has not shown the trial judge clearly abused his discretion in denying the motion to compel arbitration and stay the judicial proceedings. See Tex. R. App. P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-44 (Tex. 1992) (orig. proceeding). Accordingly, we DENY relator's petition for writ of mandamus.
