MEMORANDUM OPINION


On August 4, 2005, Marcus Caballero filed his notice of appeal in the above-numbered case. On December 20, 2005, we received a copy of an August 16, 2005 order reinstating the case to the trial court docket. Because it appeared the appeal was moot, we requested appellant to file either a motion to dismiss the appeal or a jurisdictional brief explaining why we should not dismiss the case in light of the August 16, 2005 order. We requested appellant to file either the motion or brief by January 6, 2006 and warned that his failure to do so would subject the appeal to dismissal without further notice.

As of today's date, appellant has not responded to our request. Accordingly, because it appears this appeal is moot and appellant has not responded to our request to show otherwise, we DISMISS the appeal. See Tex.R.App.P. 42.3(a), (c).
