IN RE ORVIS WAYNE PORTER, Relator

Original Proceeding from Criminal District Court No. 3 Dallas County, Texas
Trial Court Cause No. F10-24557-J

MEMORANDUM OPINION

Before Justices Lang, Myers, and Boatright
Opinion by Justice Lang

Before the Court is relator's August 21, 2017 petition for writ of mandamus. Relator has not shown that he is entitled to mandamus relief. See In re Wilkerson, 05-16-00043-CV, 2016 WL 308658, at *1-2 (Tex. App.—Dallas Jan. 26, 2016, orig. proceeding) (mem. op.) (denying petition asking court to direct trial court to rule on nunc pro tunc motion where trial court did not have jurisdiction to rule because nunc pro tunc motion sought substantive change to judgment of conviction).

Accordingly, we deny relator's petition for writ of mandamus. 170980F.P05
