This proceeding arises out of Cause No. DC-22-02, pending in the 229th Judicial District Court, Duval County, Texas, the Honorable Baldemar Garza presiding.

ORDER

PER CURIAM

Delivered and Filed:

On December 21, 2023, relator filed a petition for writ of mandamus and a motion for emergency relief. This court believes a serious question concerning the mandamus relief sought requires further consideration. See Tex. R. App. P. 52.8(b). The respondent and the real parties in interest may file a response to the petition in this court on or before January 12, 2024. Any such response must conform to Texas Rule of Appellate Procedure 52.4.

Further, real parties in interest represent they "have withdrawn their objection to [relator's motion for leave to designate responsible third parties] and expect that the trial court will revoke the order and enter an order granting [relator's motion, thus mooting any complaint related to the responsible third party issue." Any response must address whether the trial court has entered an additional order related to the responsible third party issue.

It is so ORDERED.

Relator's motion for emergency relief is HELD IN ABEYANCE.
