ORDER GRANTING WYETH'S MOTIONS TO STRIKE AMENDED COMPLAINTS AND/OR DISMISS FOR INSUFFICIENCY OF PROCESS AND DENYING PLAINTIFFS' MOTIONS FOR LEAVE TO AMEND COMPLAINT


Wyeth filed motions to strike the amended complaints of plaintiffs Carolyn Terry and William Sykes and/or to dismiss these complaints for insufficiency of process. Wyeth claims that when plaintiffs filed amended complaints pursuant to CMO No. 15, each impermissibly added Wyeth as a defendant, and that even if such additions were allowed, plaintiffs failed to effectuate proper service on Wyeth. Plaintiffs Terry and Sykes responded with motions for leave to amend their complaints to add Wyeth. Having considered these motions, the court hereby GRANTS Wyeth's motions to strike the amended complaints of plaintiffs Carolyn Terry and William Sykes, and DENIES plaintiffs' motions for leave to amend.
