ORDER
This 12th day of March, 2008, Petitioners, George M. and Maria T. Fitzgerald, having petitioned the Court for an Order restricting the distribution of their personal data maintained in the Delaware Voter Registry, and the Court having considered the Petition, it appears to the Court that:
1. Petitioners are registered to vote in the State of Delaware.
2. Petitioners have expressed concern that personal data maintained in the Delaware Voter Registry may be utilized by others in an unauthorized way, including for illegal purposes.
3. Without opposition from the Commissioner of Elections, the Court has determined that the Petitioners have demonstrated legitimate need and a lawful purpose for keeping their address and other personal data maintained in the Delaware Voter Registry confidential, pursuant to 15 Del. C. § 1303(a).
4. Accordingly, the Commissioner of Elections shall keep the Petitioners' address and other personal data maintained by the Commissioner confidential pursuant to the provisions of 15 Del. C. § 1303. To the extent disclosure of the data occurs as required under 15 Del. C. § 1303(b), the Commissioner shall advise the Petitioners of such disclosure in accordance with that provision of the statute.
