STIPULATION AND ORDER SETTING A BRIEFING SCHEDULE ON PLAINTIFF'S PETITION FOR DEFAULT JUDGMENT ON ADMINISTRATIVE AWARD UNDER LONGSHORE ACT


STIPULATION

The parties, by and through their respective counsel, and pursuant to this court's request, hereby stipulate and agree, and request the court to order, that Plaintiffs Petition for Default Judgment on Administrative Award Under Longshore Act ("Plaintiff's Petition") be treated as a dispositive motion, noted to be heard pursuant to Local Rule 7 on Friday, February 7, 2003, with defendant's opposition memorandum being due no later than Friday, January 31, 2003, and plaintiff's reply memorandum being due no later than Thursday, February 6, 2003 (the day before the hearing date).

The parties ask that the court grant their requested briefing schedule on Plaintiff's Petition by signing the order set forth below.

ORDER

The parties, through their respective counsel, as requested by this court, have stipulated and agreed on a briefing schedule for Plaintiffs Petition for Default Judgment on Administrative Award Under Longshore Act ("Plaintiffs Petition"), treating Plaintiff's Petition as a dispositive motion, noted to be heard on Friday, February 7, 2003. The parties request that defendant's opposition memorandum be due no later than Friday, January 31, 2003, and that plaintiffs reply memorandum be due no later than Thursday, February 6, 2003 (the day before the hearing date).

The court, having examined the stipulation of the parties, and being fully advised, now therefore:

ORDERS, ADJUDGES, AND DECREES (1) that Plaintiffs Petition for Default Judgment on Administrative Award Under Longshore Act shall be treated as a dispositive motion noted to be heard by this court without oral argument on Friday, February 7, 2003, (2) that defendant's opposition memorandum shall be due to be filed and served no later than Friday, January 31, 2003, and (3) that plaintiffs reply memorandum shall be due to be filed and sewed no later than Thursday, February 6, 2003.
