Opinion

No. 04-06-00173-CV

Delivered and Filed: April 5, 2006.

Original Mandamus Proceeding.

Petition for Writ of Mandamus Dismissed for Lack of Jurisdiction.

Sitting: Sarah B. DUNCAN, Justice, Karen ANGELINI, Justice, Phylis J. SPEEDLIN, Justice.

MEMORANDUM OPINION

Noe Peña seeks a writ of mandamus directing C. Woodard and Elwood Putnam of the Texas Criminal Justice Department Parole Division to withdraw Peña's parole revocation warrant and order his release from custody. This court does not have jurisdiction to issue a writ of mandamus against the Parole Division and its employees unless such a writ would be necessary to enforce our jurisdiction. See Tex. Gov't Code Ann. § 22.221 (Vernon 2004). Peña makes no such showing. Accordingly, Peña's petition for a writ of mandamus is dismissed for lack of jurisdiction.
