IN RE FIDEL LUIS PENA III AND THE FIDEL L. PENA III LAW FIRM, PLLC

On Petition for Writ of Mandamus.

Before Chief Justice Contreras and Justices Silva and Pena

ORDER

PER CURIAM

Relators Fidel Luis Pena III and the Fidel L. Pena III Law Firm, PLLC have filed a petition for writ of mandamus and a motion to stay the trial court proceedings in the above-referenced cause number. By petition for writ of mandamus, relators contend that the trial court abused its discretion by refusing to grant relators' motion to strike a plea in intervention filed by the real parties in interest, Francisco J. Garza and Frank Garza Law Firm, PLLC. By motion to stay, relators seek to stay the trial court proceedings pending the resolution of this petition for writ of mandamus.

The Court, having examined and fully considered the motion to stay, is of the opinion that it should be granted. Accordingly, we grant the motion to stay, and we order the underlying proceedings to be stayed pending the resolution of this matter or further order of this Court. See TEX. R. APP. P. 52.10(b) ("Unless vacated or modified, an order granting temporary relief is effective until the case is finally decided."). We request the real parties in interest, or any others whose interest would be directly affected by the relief sought, to file a response to the petition for writ of mandamus on or before the expiration of ten days from the date of this order. See id. R. 52.2, 52.4, 52.8.
