This proceeding arises out of Cause No. 2015CI05672, styled William F. Pettinati Jr., Nicholas P. Garofolo, Sigma Gas Barbastella Fund, Sigma Gas Antrozous Fund, as Direct Plaintiffs and Derivatively on Behalf of Giddings Oil & Gas LP, Hunton Oil Partners LP, and ASM Energy Fund III LP and Starboard Resources, LLC v. Charles S. Henry III, William Liao, Bradford Higgins, SOS Ventures LLC, Peter Thomas Benz, Michael Joseph Pawelek, Edward Shaw, Eric Alfuth, Craig W. Dermody, Sean Mathis O'Sullivan and Starboard Resources, LLC, pending in the 438th Judicial District Court, Bexar County, Texas, the Honorable Gloria Saldaña presiding.
On January 29, 2016, relators filed a petition for writ of mandamus and emergency motion for temporary relief pending a ruling on the mandamus petition. The court has considered the petition for writ of mandamus and is of the opinion that relators are not entitled to the relief sought. Accordingly, the petition for writ of mandamus and emergency motion for temporary relief are denied. See TEX. R. APP. P. 52.8(a).
Counsel for Bradford Higgins and SOS Ventures LLC filed a notice of joinder in the mandamus petition on February 1, 2016 and are accordingly included as relators in this proceeding. --------
