ORDER
¶1 Department II of the Court, composed of Chief Justice Fairhurst and Justices Madsen, Stephens, González and Yu, considered this matter at its February 7, 2017, Motion Calendar and unanimously agreed that the following order be entered.
¶2 IT IS ORDERED:
¶3 That the Petitioner's Motion for Discretionary Review is granted only as to the following four issues: (1) whether the jury instructions regarding self-defense were erroneous and whether trial and appellate counsel were ineffective on this issue, (2) whether the Petitioner is entitled to a new trial based on newly discovered evidence, (3) whether the State reversibly violated evidence disclosure obligations, and (4) whether defense counsel was ineffective. Review of all other issues is denied. Any party may serve and file a supplemental brief within 30 days of the date of this order, see RAP 13.7(d).
