Opinion

No. 05-08-01668-CV

Opinion issued December 23, 2008.

Original Proceeding from the 193rd Judicial District Court, Dallas County, Texas, Trial Court Cause No. DC-08-13423-L.

Before Justices BRIDGES, RICHTER, and FRANCIS.

MEMORANDUM OPINION

Relators contend the trial judge erred by compelling relator Theresa M. Patton, M.D.'s deposition on December 19, 2008. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relators have not shown they are entitled to the relief requested. See Tex. R. App. P. 52.8(a); In re Prudential Ins. Co. of Am., 148 S.W.3d 124, 135-36 (Tex. 2004). Accordingly, we DENY relators' petition for writ of mandamus.
