Original Proceeding on Petition for Writ of Mandamus

MEMORANDUM OPINION

Relators, The Park Square Co-Owners Association and Stephen Russell, filed a petition for a writ of mandamus challenging the trial court's temporary restraining order, enjoining relators from implementing and enforcing temporary restrictions at a multi-family residential community. Relators have filed an unopposed motion requesting that we dismiss the petition without prejudice.

The underlying case is Fratelli Designs, LLC v. The Park Square Co-Owners Ass'n and Stephen Russell, Cause No. 2020-22266, in the 133rd District Court of Harris County, Texas, the Honorable Jaclanel McFarland presiding.

Accordingly, we grant relators' motion and dismiss their petition for writ of mandamus without prejudice. All pending motions as dismissed as moot.
