ORDER DENYING PLAINTIFF'S MOTION FOR RECONSIDERATION OF RULING GRANTING SUMMARY JUDGMENT FOR DEFENDANT


This proceeding came before the Court upon Plaintiff's Motion for Reconsideration of Ruling Granting Summary Judgment for Defendant and Defendant's Opposition to Plaintiff's Motion for Reconsideration. On June 13, 2006 the Court entered Order Granting Defendant's Motion for Summary Judgment. Plaintiff seeks reconsideration of that order.

The three grounds which justify granting a motion to alter or amend a judgment are: 1) an intervening change in controlling law; 2) the availability of new evidence; and 3) the need to correct clear error or prevent manifest injustice. In re Mulberry Phosphates, Inc., 62 F.Supp.2d 1316, 1331 (M.D. Fla. 1999). The Court finds that none of the three grounds is implicated in the instant proceeding. Accordingly, it is

ORDERED:

Plaintiff's Motion for Reconsideration of Ruling Granting Summary Judgment for Defendant is denied.
