Opinion

No. 05-04-01156-CV

Opinion Issued October 6, 2004.

Original Proceeding from the 265th Judicial District Court, Dallas County, Texas, Trial Court Cause No. F-004-72-93-R.

Writ of Mandamus Denied.

Before Justices WRIGHT, O'NEILL, and LANG.

MEMORANDUM OPINION

Relator contends the trial judge erred in denying his application for chapter 64 forensic testing and request for an appointment of an attorney for the chapter 64 action. We conclude the trial judge did not abuse his discretion in denying relator's application for chapter 64 forensic testing and request for an appointment of an attorney for the chapter 64 action. Further, we conclude relator has failed to show does not have an adequate remedy at law. Accordingly, relator's petition for writ of mandamus is DENIED. See Tex.R.App.P. 52.8(a); Tex. Code Crim. Proc. Ann. arts. 64.01, 64.05 (Vernon Supp. 2004).
