In re P. D. Howe Minor

LC No. 2022-001968-NA

Mark J. Cavanagh Presiding Judge Michael J. Riordan Sima G. Patel Judges

ORDER

This Court's opinion and order, entered on October 19, 2023, vacated in part the trial court's order terminating respondent's parental rights, and remanded, while retaining jurisdiction, for further proceedings. Specifically, this Court vacated the trial court's best-interest analysis and ordered the trial court to make findings with respect to the relative placement in the context of its overall best-interest analysis. On remand, the trial court determined termination of respondent's parental rights was in the child's best interest, finding that respondent's "poor insight, defensiveness, evasiveness, minimalization, denial, rationalization, justification, lack of self-control and lack of respect for boundaries demonstrate that he would be a continual threat to his child[,]" even though the child is placed with her mother. Because the remand proceedings have concluded and rendered moot any remaining appellate issues, the parties are permitted to file supplemental briefs. Each party's supplemental brief is limited to five pages and must be filed within 21 days of this order.
