Original Proceeding on Petition for Writ of Mandamus

MEMORANDUM OPINION

Relators, Old Dominion Freight Line, Inc. and Gregory Lee, have filed a petition for a writ of mandamus challenging orders compelling the production of documents in the underlying trial court proceeding. Relators, representing that the parties have resolved and settled all disputes and claims in that proceeding and the mandamus petition is now moot, have filed a motion to voluntarily dismiss their petition. No opinion has issued. See TEX. R. APP. P. 42.1(c). Further, more than ten days have passed and no party has responded to the motion. See id. 10.3(a).

The underlying case is Cheryl Dugar, Individually and as Next Friend of H.D., a Minor v. Old Dominion Freight Line, Inc., Alca, Inc., Gregory Lee, and Richard Carter, No. 2015-75740, in the 215th District Court of Harris County, Texas, the Honorable Elaine H. Palmer presiding.

Accordingly, we vacate our August 11, 2017 order staying the trial court's July 28, 2017 and August 8, 2017 orders, grant relators' motion, and dismiss the petition.
