MEMORANDUM OPINION


Relator contends the city secretary for the City of Dallas, Texas erred in not including his name as a candidate for the office of mayor of the City of Dallas, Texas on the ballot for the general election to be held May 3, 2003. The facts of this original proceeding are known to the parties so we do not recite them here. Further, because all dispositive issues are clearly settled in law, we issue this memorandum opinion pursuant to rule 52.8(d) of the Texas Rules of Appellate Procedure. See Tex.R.App.P. 52.8(d). On April 8, 2003, the parties filed a copy of a "rule 11 memorandum of settlement agreement" with this Court which states that relator's name will appear on the May 3, 2003 general election ballot for the office of mayor of the City of Dallas, Texas. Because the parties have settled all matters at issue in this original proceeding, we DISMISS the petition for writ of mandamus.
