On October 18, 2023, Relator Augustine Nchekwube Okoli filed a Petition for Writ of Mandamus. See Tex. Gov't Code § 22.221; see also Tex. R. App. P. 52. In his Petition, Relator requests that we vacate the trial court's September 26, 2023 order denying his Plea to the Jurisdiction. Relator's petition does not comply with the Texas Rules of Appellate Procedure. See Tex. R. App. P. 52.7(a).
Relator is directed to supplement his appendix with the response, if any, filed by Real Party in Interest Chidinma Augusta Okoli to Relator's Plea to the Jurisdiction. See Tex. R. App. P. 52.7(a)(1). To the extent the trial court conducted a hearing on the Plea to the Jurisdiction, Relator is further requested to supplement the record with "a properly authenticated transcript of any relevant testimony from any underlying proceeding, including any exhibits offered in evidence," or provide a "statement that no testimony was adduced in connection with the matter complained." Id. 52.7(a)(2). Relator is ordered to file such supplementation on or before Friday, October 27, 2023. Failure to supplement the record as directed may result in the dismissal of Relator's petition.
We further request a response to the Petition for Writ of Mandamus from Real Party in Interest. The response(s), if any, is due on or before Monday, October 30, 2023.
