MEMORANDUM OPINION


The Office of the Attorney General of Texas filed a petition for writ of mandamus to compel the trial court to vacate an order for parentage testing in a suit to modify the parent-child relationship. See Tex. R. App. P. 52. The modification proceeding was subsequently non-suited. See Tex. R. Civ. P. 162. On October 18, 2010, the relator filed a motion to dismiss the petition for writ of mandamus as moot. Accordingly, we dismiss this original proceeding without reference to the merits.

PETITION DISMISSED.
