Opinion
No. 05-17-00210-CV
06-19-2017
On Appeal from the 254th Judicial District Court Dallas County, Texas
Trial Court Cause No. DF-13-23371
MEMORANDUM OPINION
Before Chief Justice Wright, Justice Lang-Miers, and Justice Stoddart
Opinion by Chief Justice Wright
Appellant appeals from the trial court's December 1, 2016 Order of Enforcement by Contempt. Appellant also filed a petition for writ of mandamus related to the enforcement order and the trial court's December 1, 2016 Temporary Orders in Suit to Modify Parent-Child Relationship. This Court issued its opinion and order in the mandamus proceeding on June 5, 2017. See In re Eddins, No. 05-16-01451-CV, 2017 WL 2443138 (Tex. App.—Dallas, orig. proceeding [mand. denied]) (mem. op.). In Eddins, we held that the enforcement order was by its own terms a temporary order and, therefore, not appealable. Id. at * 6-7. This Court conditionally granted the petition for writ of mandamus and directed the trial court to issue a written ruling vacating the December 1, 2016 temporary orders and reinstating the agreed final divorce decree. Id. at *12. In light of our opinion in Eddins, we dismiss this appeal for want of jurisdiction. See TEX. R. APP. P. 42.3(a).
