IN THE INTEREST OF J.A.K. AND J.A.K., CHILDREN

On Appeal from the 301st Judicial District Court Dallas County, Texas
Trial Court Cause No. DF-13-22708

MEMORANDUM OPINION

Before Justices Lang, Myers, and Evans
Opinion by Justice Lang

This is an appeal from the trial court's April 18, 2016 judgment in a parental termination case. Although appeals in parental termination cases are accelerated and must be filed within twenty days of the signing of the judgment or, with a timely extension motion, within thirty-five days of the judgment, this appeal was filed eighty days after the judgment was signed. See TEX. R. APP. P. 26.1(b), 26.3, 28.4(a). Because the timely filing of a notice of appeal is jurisdictional, we directed appellant to file, no later than October 24, 2016. a letter brief addressing the timeliness of the appeal. See Garcia v. Hibernia Nat'l Bank, 227 S.W.3d 233, 233 (Tex. App.—Houston [1st Dist.] 2007, no pet.). To date, appellant has not responded. Accordingly, on the record before us, we dismiss the appeal. See TEX. R. APP. P. 42.3(a).
